Tom Kahana

Biography

Tom Kahana is a partner in the litigation department at our Tel Aviv office.

Tom handles civil-commercial litigation cases, with a particular focus on derivative and class actions in the areas of corporate governance and officer and director liability as well as securities and consumer protection.

In addition, Tom provides ongoing counsel and advice to various tender committees, and representation in legal proceedings concerning tender law disputes.

Tom represents leading companies in the fields of holdings, consumer, insurance, energy and pharma, as well as leading foreign companies in civil proceedings conducted in Israel (both representative proceedings and ordinary court proceedings), as part of his experience in oppositions to service ex juris.

Tom is a member of the Israel Bar Association’s Class Actions and Derivatives Committee

He also serves as a permanent member of the Election Committee of the Association of Senior Football Teams in Israel.

Tom began his work at the firm as an intern in the litigation department.

  • Represented an international electronics company in a class action accusing an international cartel of price fixing flat screen panels, and in the drafting and validation of a precedent-setting settlement agreement.
  • Represented a leading Israeli insurance company in a series of class actions alleging breach of the duties of officers in an Israeli investment fund.
  • Represented a controlling shareholder in an Israeli public company in a class action alleging liability for damages caused as a result of the company’s reports on their legal proceedings.
  • Represented an Israeli high-tech company in a class action filed by foreign bond investors on the grounds of misleading investors in raising the debt, and in an appeal against the class action’s dismissal.
  • Represented directors of a public company in a derivative action concerning the alleged distribution of dividends arising from the revaluation of the company’s holdings.
  • Provided representation in a derivative action against directors of an independent committee of a leading public holding company, which challenged the committee’s decision to participate in a debt settlement of a subsidiary.
  • Provided counsel to a management company of the Ministry of Construction and Housing regarding the administration of tender committees, and representation in administrative petitions in respect of tender law.
  • Represented an energy company in a petition for revoking a decision of the tenders committee of the Israel Electric Corporation.
